Forensics in New York Custody Cases

Forensic examinations can be an extremely useful tool employed by the courts to offer the judge a clearer picture of both parent-child relationships, the child’s home life, and other factors that are considered when establishing a custody arrangement.

What are forensics in child custody cases?

Forensics is the term for investigations and documents (such as reports) that are submitted by a mental health or other professional to help the court determine what custody arrangement is in the best interest of the child. In some cases, the investigator will make a recommendation and, in others, their findings are presented in a neutral way. For child custody disputes, forensic investigators are usually psychiatrists, psychologists, or social workers. The forensic investigator is usually appointed by the court, but the court is not required to rule in accordance with the investigation report.

What happens during a forensic investigation?

While the forensic investigator is conducting their investigation, they may employ a number of methods to get a clear picture of the stability and safety of a parent-child relationship. The expert will usually speak to the child as well as the parents, but can widen their investigation to interviewing relatives, friends, teachers, caregivers, coaches, or anyone else who might have input that would help the investigator determine the best interest of the child. The investigator’s objective is to illuminate (either directly or indirectly) what custody arrangement is in the best interest of the child.
